BACKYARD OF YOUR DREAMS SWEEPSTAKES CONTEST RULES 1. NO PURCHASE NECESSARY 2. ELIGIBILITY This Contest starts on Friday, February 9, 2007 and ends on Sunday, June 15, 2007 (Contest End Date). To be eligible for this Contest, on-line and mail-in entries must be received on or before, 11:59 p.m. Pacific Standard Time on the Contest End Date. Incomplete or late entries will not be accepted. This Contest is open to:
Employees of Nutrilawn Inc. and their representatives, agents, advertising and promotional agencies, affiliated and related companies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they live) and household of such employees; and The Toro Company, and its owners, affiliates, and members of their immediate families, are not eligible. 3. HOW TO ENTER Only one entry of any type whatsoever is permitted per residence. All multiple entries, mass entries or reproductions submitted are automatically disqualified. You may enter by: Online Entry: Logging onto www.BackyardOfYourDreams.com and complete an online entry form in full and click "Enter" to submit your entry for receipt by contest closing date of 11:59 p.m. (PST) June 15, 2007. For purposes of these Official Rules and Regulations, "receipt" of an online entry occurs when Sponsor's servers record the entry information upon the entrant clicking the "Entry" button. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor of an entry for purposes of these Official Rules and Regulations. In your entry, you will be asked to provide your first and last name, street address, city, province/state, postal/zip code, phone number, date of birth, gender, e-mail address and where you heard about the contest. All mandatory fields must be completed. Nutrilawn Inc. (Sponsor) is not responsible for late, lost, misdirected, illegible or incomplete entries, which will be void. The use of any automated equipment to participate in this Contest is prohibited. In the event of a dispute as to who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If a selected entrant's entry is an Internet entry, the selected entrant may be required to provide Nutrilawn Inc. with proof that the selected entrant is the authorized account holder of the e-mail address associated with the selected entry. Entrants are required to provide truthful and accurate information in all contest entries and Administrator will disqualify any entry that the Administrator determines, in its sole discretion, to be false or fraudulent. All Entry Data becomes the property of Administrator and will not be returned, or used for additional purposes unless otherwise stated. By entering, you consent, should you become a winner, to Nutrilawn Inc.'s use, of your name, place of residence and photograph or other likeness, without further compensation or notice, for publicity, advertising or informational purposes in any media or format (including the Internet) in connection with this Contest or future similar contests. All entries become the property of Nutrilawn Inc. and will not be returned to entrants. 4. PRIZE: Grand Prize One (1) TORO Lawn Mower Personal PaceŽ (20058), valued at $1,039.95 CND, one (1) TORO Cordless Hedge Trimmer (51596), valued at $159.95 CND, one (1) TORO Ultra 225 Blower Vac (51598), valued at $139.95 CND, and one (1) TORO 18" Straight Shaft Gas Trimmer (51932), valued at $259.95 CND, (1) Nutri-Lawn Lawn Makeover, valued at $450.00 CND, and a Nutri-Lawn full season comprehensive Lawn Care Program (traditional or organic) valued at $299.00 CND for up to 3,000 square feet. The grand total value is $2,348.80 CND (approx. $1,761.60 US). Early Bird Prizes Eight (8) Nutri-Lawn Lawn Makeovers, valued at $450.00 CND (approx. $381.00 US) which consists of:
The Lawn Makeover prizes are limited to lawns up to 3,000 square feet. For lawns over 3,000 square feet, Nutri-Lawn franchisees will provide those winners with an estimate for the additional square footage. Total prizes to be awarded is valued at $5,948.80 CND (approx. $4461.60 US) The odds of winning a prize depend on the total number of eligible entries received, including all paper and online entries by the contest closing date. All expenses, taxes, surcharges and issuance or other fees not described as included in the Prize are the sole responsibility of the winner. Except as expressly warranted herein, the prizes are provided to winners "as is" without further warranty of any kind. Prize must be accepted as awarded. NO SUBSTITUTION OF PRIZES IS PERMITTED EXCEPT BY SPONSOR IN ITS SOLE DISCRETION. SELECTION OF WINNERS EARLY BIRD DRAW Every second Friday, starting February 9, 2007, during the contest period, there will be one Early Bird random draw for a chance to win one of eight Nutri-Lawn Complete Lawn Makeovers . The EARLY BIRD draws will take place at 12:00 a.m. (PST) on the following dates: Friday, February 23, 2007; Friday, March 9, 2007; Friday, March 23, 2007; Friday, April 6, 2007; Friday, April 20, 2007; Friday, May 4, 2007; Friday, May 18, 2007; and Friday, June 1, 2007. The early bird draws will be completed by a Nutrilawn Inc. ("Nutri-Lawn") representative, from all completed entry forms received by 11:59 p.m. (PST) on the Thursday before the listed draw dates above, at Nutri-Lawn's office at 185 The West Mall, W. Suite 110, Toronto, Ontario, Canada M9C 5K6. GRAND PRIZE AND SECOND PRIZE DRAW A random draw for the Grand Prize and Second Prize, by Nutrilawn Inc. ("Nutri-Lawn") representative, from all completed entry forms received by 11:59 p.m. on the Contest Closing Date will be made on June 15, 2007 at Nutri-Lawn's office at 185 The West Mall, Suite 115, Toronto, Ontario, Canada M9C 5L5. In order to win, the selected entrant must first correctly answer a time-limited skill-testing question to be administered by telephone and sign a standard declaration and release form confirming compliance with the contest rules and acceptance of the prize as awarded. The prize will be delivered to the winner. All entries become the property of Nutrilawn Inc. No correspondence will be entered into except with the selected entrant who will be notified by telephone. Selected entrants will be contacted by the phone number indicated on the selected entrant's online entry form.
6. GENERAL TERMS AND CONDITIONS Entrants agree that their submission of an entry constitutes acceptance of and agreement to abide by the terms and conditions of these Official Rules and by all decisions of Nutrilawn Inc., which are final in all matters pertaining to the Contest. The contest is subject to all applicable federal, provincial and municipal laws. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. By entering, participants release and hold harmless Nutrilawn Inc., its affiliated and related companies and advertising, promotion agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the "Contest Entities") from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any prize won. Winners will be required to sign and return, within the time period indicated on the documents, a Declaration of Compliance with Contest Rules and a full Liability and Publicity Release and/or any other document which may be reasonably required by the Sponsor or the Administrator. Nutrilawn Inc. reserves the right at its sole discretion to disqualify any individual from the Contest and to ban the individual from any future contest of Nutrilawn Inc. that it finds or believes to be tampering with the entry process or the operation of the Contest or Contest Website; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NUTRILAWN INC. RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 7. LIMITATIONS OF LIABILITY Without limiting the release in Paragraph 6 above, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by Contest Website users or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in operation of the contest website or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to participants' or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Contest Entities which corrupt or affect the administration, security or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way. 8. PRIVACY By entering the contest, Entrant(s) agree to Nutrilawn Inc.'s use of Entrant(s) personal information as described in Nutrilawn Inc.'s Privacy Policy at: http://www.nutri-lawn.com/privacy.htm. 9. WINNERS LIST The name of the prize winners will be posted on Nutrilawn Inc.'s website. Entrants by entering this contest, consent to use of their name, city of residence and/or photograph, without compensation, in any future publicity carried out by Sponsors in connection with this contest. This contest is sponsored and administered by Nutrilawn Inc. (Sponsor). This contest is VOID where prohibited or restricted by law. This contest is subject to these complete official rules. In the event that any dispute arises regarding the meaning or interpretation of these Rules, contestants agree that the dispute shall be resolved by applying the laws of Ontario, Canada and that it shall be resolved in and by the courts of that province.
